History of ARCO
ARCO, a collecting society founded in September
of 1989, is admitted to institute by the Ministry of Interior, registered
as a public welfare organization in the District Court of Taipei, and
authorized to manage public broadcast of sound recordings and to collect
royalties for the copyright owners.
In
January 1999, after acquired the approval from the competent
authority, ARCO is registered later in June as a copyright
intermediary organization to manage the economic rights of sound recording
in compliance with the Copyright Intermediary Organization Act.
Furthermore,
ARCO is in addition authorized the right to collect remuneration
of public performance of sound recordings since July 2003 after
the latest Copyright Law amendment is promulgated.

Member
The
members of ARCO are more than 29 leading record companies in Taiwan, most
of which are members of IFPI. IFPI, International Federation of the
Phonographic Industry, is an international organization, which established
IFPI Members' Foundation in Taiwan.
Its main mission is anti-piracy. Besides the commission to members, ARCO
is the agent to manage the authority of sound recordings of the more than
1,400 lables all over the world of the members of IFPI.

Organization
The
highest authority mechanism of ARCO is the Membership Meeting, whose major
duty is concluding and modifying the articles of ARCO, supervising the
works of directors and supervisors, and resolving the important matters
about the rights and obligations of members, etc..
Under the Membership Meeting, there
is the Board of Directors, whose major duty is deciding the summons of
Membership Meeting, establishing the Board of Supervisor to supervise
directors' works, examining the annual accounting settlement, and other
supervising matters.
According to the decision of
Membership Meeting, there is one
CEO
to conduct the management of ARCO. Under
CEO, the following
departments deal with ARCO official affairs, such as Legal Department,
Royalty Administration Department, MIS Department, Accounting Department
and Secretariat Department.
The establishment of Royalty
Re-examination Committee and Arbitration Committee is to examine the
shares of royalties and solving the disputes of rights and obligations of
members.

General state
Considering
the systems of other countries and the condition of every user in Taiwan,
we set up a tailor-made Royalty System of our own. After collecting the
royalties and deducting our management fees, ARCO distributes the
royalties to members according to the ratio users report.
At
present, our licensed broadcasting user includes cable/traditional
television stations, cable/ traditional radio stations and satellite
channel operators . For those who play cassettees , CDs or musical
programs with amplifiers, recorders, or other apparatus in premises such
as convenience stores, shopping mall or retail stores , shall apply a
public performance licence from us.

Why Must Contract with ARCO
According
to the Copyright Law of Taiwan, the sound recordings have the public
broadcasting rights. The owners of the rights are entitled to get the
royalties from people who use the works.
For example: Using sound recordings
on TV or radio programs and broadcasting those programs to the public is
public broadcasting. If the users use the sound recordings of ARCO members
for public broadcast they must contract ARCO.
